Abstract
Tujuan: Penelitian ini bertujuan untuk menganalisis eksistensi hukum adat sebagai sumber hukum dalam sistem hukum Indonesia melalui pendekatan historis dan kontemporer. Hipotesis yang dibangun adalah bahwa hukum adat, meskipun telah memperoleh pengakuan normatif dalam berbagai instrumen hukum nasional, belum sepenuhnya diimplementasikan secara substantif dalam praktik hukum negara.
Metode Penelitian: Penelitian menggunakan metode hukum normatif dengan pendekatan historis, konseptual, dan perundang-undangan. Data diperoleh melalui studi kepustakaan terhadap regulasi, putusan pengadilan, serta dokumen-dokumen akademik dan kebijakan yang relevan. Data dianalisis secara deskriptif-analitis untuk memetakan perkembangan hukum adat dan tantangan integrasinya dalam sistem hukum nasional.
Hasil dan Pembahasan: Hasil penelitian menunjukkan bahwa hukum adat memiliki dasar historis yang kuat dan relevansi kontemporer yang tinggi, tetapi masih menghadapi kendala struktural, politik, dan administratif dalam pengakuan dan pelaksanaannya. Temuan ini membuktikan bahwa fragmentasi kebijakan daerah, ketiadaan kodifikasi nasional, serta dominasi sistem hukum positivistik menjadi penghalang aktualisasi hukum adat.
Implikasi: Implikasi dari penelitian ini mengarah pada perlunya reformulasi kebijakan hukum nasional yang pluralistik dan inklusif terhadap sistem hukum lokal. Diperlukan kajian lanjutan yang bersifat empiris untuk menggali dinamika hukum adat di berbagai daerah secara lebih mendalam.
